Life & Accidental Death Insurance

Many people are surprised to hear that Tucker & Ludin handles Life Insurance cases.  Most people ask how there could ever be a dispute in a Life Insurance or Accidental Death & Dismemberment (AD&D) insurance case. Although it may not seem obvious, these claims are often denied.  Some examples of the denials we have fought for our clients:

  • Improper enrollment in an insurance plan.

  • Improper beneficiary designations or disputes over which beneficiary should get paid (this often happens after a divorce).

  • Disputes about whether a death or dismemberment (loss of a limb) was an “accident.”

  • Conversion denials - When someone has life insurance through their job, they may be able to switch their policy from a group to an individual policy when they leave that job. Sometimes, the insurance company will deny that coverage.

  • Premium Waiver for Disability - Many policies will waive your Life or AD&D premium if you become disabled while the Life or AD&D coverage is in force. In other words, the insurer may allow you to keep the Life or AD&D insurance coverage, and you do not have to pay a premium for as long as you are disabled.

  • Credit Life Insurance on mortgages or other loans.
